Legal Notice

By sending us your videotape, and in consideration of our acceptance of your videotape for our use, you consent that we may, by our sole discretion, use it or any part of it and your image, voice and likeness in our television special/documentary currently entitled, "Changed Lives: Miracles of The Passion," and in any other derivative or related programs/documentaries we may create in any form or format, for broadcast or other distribution, without further consideration. All submissions imply agreement with the following Legal Notice:

I. GENERAL DESCRIPTION

Jody Eldred Productions, the producer ("Producer") of a nationwide television special with the working title “Changed Lives: Miracles Of The Passion” seeks submission by members of the public of footage capturing short (up to 20 seconds) stories/testimonials related to their experiences of movie “The Passion of The Christ” for possible broadcast on national television or for distribution via other media. Submissions will be evaluated, and stories will be chosen for inclusion at the Producer’s sole discretion.

II. PROCEDURES

1. Persons wishing to send a story submission should send as many different videos as they wish to "Miracles of the Passion," 13428 Maxella, #626, Marina Del Rey, CA 90292. Tapes will be reviewed on an ongoing basis. See section IV for deadline.

2. Entrants should include state their name, address, telephone number, on the videotape of the story being submitted.

3. All submissions shall become the sole property of the Producer. Producer is not responsible for lost, damaged or misdirected tapes under any circumstances. Please keep a copy of your story submission.

4. All home video formats are acceptable (e.g. VHS, 8MM, Hi-8, digital video). Home videos transferred to DVD or CD-ROM will also be accepted. 8MM film transferred to videotape is also accepted.

5. Producer reserves the right to edit and/or alter any submission.

6. Videos must be submitted for exclusive use by Jody Eldred Productions.

7. Decisions related to choice of inclusion by the Producer are final and nonnegotiable. All submissions are subject to the terms of these rules and all those submitting story footage agree to be bound by these rules. Producer reserves the right to amend these rules at any time.

ELIGIBILITY

1. Persons under 18 may submit a story, but written parental consent will be required before their stories will be considered.

2. Persons submitting a story for inclusion in this program MUST do so with a completed Waiver and Release Agreement Form presented attesting, among other things, to the fact that they are the rightful owners of the submitted footage, and that the footage may be submitted and broadcast without obtaining permission from or making any payment to any third party. All persons appearing in the footage must sign the Release Agreement. Parent or guardian must sign the release form for minors. Failure to provide requested releases will result in inability to use the footage in the program. Notwithstanding the foregoing, the submission of a videotape constitutes the submitter's permission to use the videotape in and in connection with the program and all exploitations thereof, including, without limitation, advertising and promotion and, further, constitutes the submitter's representation that all necessary consents and permissions therefore have been obtained.

3. Each submission must be solely the original story of the submitter.

4. Each submitter represents that his/her submission does not infringe on any third party's copyrighted material, trademark or other intellectual property rights.

5. By submitting a videotape, each submitter agrees to release, discharge, and hold harmless Jody Eldred Productions, their respective affiliated companies, licensees, and assigns, and their respective officers, directors, employees, agents and representatives from any claim or liability arising from or related to submission of the footage and/or appearance in the program.

6. Each entrant agrees that his/her submission shall be governed by and construed under and in accordance with the laws of the State of California applicable to contracts entered into and wholly performed therein. Each entrant consents and agrees to the exclusive jurisdiction of the federal and state courts of the State of California, located in the County of Los Angeles.

SUBMISSION DEADLINE

1. The deadline date for submission is March 25, 2004 March 30, 2004. All tapes must be received by Producer on or before the deadline dates to be eligible for inclusion in the program.

2. At Producers' sole option, any video may be retained and considered for use and reuse, and used and reused, in any subsequent edition of the program, or any other program or ancillary use in any media.

RELEASES

1. All persons submitting videotapes must complete and sign the Waiver and Release Agreement Form provided by Producer, and include the completed form along with the submission, or be eliminated from consideration. The release includes, among other things, a statement that the videos are the exclusive property of the submitter(s), and that the stories reported were in fact personal experiences, and not fictitious.

2. Releases must be obtained from all identifiable persons depicted in videos. Parent or guardian must sign the release for minors.
